By accessing or using the LockStep platform and related services provided by ICYWALL ("we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users of the Service, including administrators, assistants, and any person interacting with the platform.
2. Description of Service
LockStep is a lab management platform that enables institutions to:
- Monitor and control networked devices in real time
- Enforce exam mode lockdowns to prevent unauthorized access during assessments
- Broadcast a teacher's screen to student devices
- Manage application whitelists for practical examinations
- View live screenshots and device metrics from a centralized dashboard
- Send remote commands (restart, shutdown, push URL, run scripts)
3. Account Registration
To use certain features, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Service to monitor individuals without proper authorization or consent as required by applicable law
- Attempt to bypass, disable, or interfere with security features of the Service
- Reverse engineer, decompile, or disassemble any part of the Service or agent software
- Use the Service to transmit malware, viruses, or any harmful code
- Share or redistribute the agent software outside your licensed scope
- Use the Service in any manner that could damage, disable, or impair the Service
5. Institutional Responsibility
If you deploy LockStep within an educational institution or enterprise:
- You are responsible for informing device users (students, employees) that monitoring software is installed
- You must comply with all applicable privacy laws and institutional policies regarding device monitoring
- You are responsible for managing user roles and access permissions within your organization
- Screen captures and device data collected are your institution's responsibility to manage appropriately
6. Intellectual Property
The Service, including its software, design, logos, and documentation, is owned by ICYWALL and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service during your subscription period.
7. Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may temporarily suspend the Service for:
- Scheduled maintenance (with reasonable advance notice)
- Emergency security patches
- Circumstances beyond our reasonable control
8. Payment Terms
Certain features require a paid subscription. Payment terms are as follows:
- Fees are billed in advance on a monthly or annual basis
- All fees are non-refundable unless otherwise stated
- We reserve the right to change pricing with 30 days' advance notice
- Failure to pay may result in suspension or termination of your account
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- ICYWALL shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for actions taken by authorized administrators using the platform's monitoring and control features
11. Termination
Either party may terminate these Terms at any time. Upon termination:
- Your access to the Service will cease immediately
- We will delete your data within 30 days, unless retention is required by law
- Provisions that by their nature should survive termination will remain in effect
12. Modifications to Terms
We may modify these Terms at any time by posting the revised version on this page. Material changes will be communicated via email or dashboard notification. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction in India.
